There are two parts to the recovery of funds from the auction sale. First, we audit the loan that the lender was foreclosed on. We know lenders make mistakes, so we review how the lender came up with what they are saying you owed. We go line-by-line on the lenders statement of your loan to determine if the lender overstepped what they can charge you. Next, we look at what the property sold for. at the auction.
The short answer is IT DEPENDS. Some law firms that work for the lender won’t respond to our “attorneys demand letters” until 90 days after the auction. While other law firms will respond in a week. On average, it is 90 days. We have gotten our client a refund in two weeks, and we have had files that take a year to complete (heirship, deceased parties).
We need confirm some basic information from the lender’s law firm before we can wire/overnight a partial refund check to our client. We need to verify that the opening bid at the auction was a “total owed by the borrower” amount (this could take between 1 week and 10 weeks). then we verify the closing bid at the auction. Finally, we then research the title and make sure that there are no other liens against the property owner’s name or property (this takes 2 days).

The fee for our service is $0 (zero), if we are not able to get you a refund. TXRRE pays all the attorney fees whether we get you a refund or not. If we are successful in getting you a refund, we charge a flat rate percentage between 5% to 30% of the amount we recovered. For example, if we recovered $10,000, we would receive $2,000 and you would receive $8,000 via a check or wire. All attorney fees are paid by TXRRE.
